Who we are

Cipher Evolution is run by Trend Enterprises Limited, a New Zealand company ("we", "us"). You can reach us at hello@cipherevolution.com.

What you are buying

When you adopt a character, or pay to take a child home after a custody battle, you get that character in the Cipher Evolution game: the name is yours in the game, nobody else can be born with it, it is shown as yours, and you can bring it into the Evolution Chamber.

A character is part of the game and nothing more. It is not a cryptocurrency, token or NFT, it is not a financial product or investment, and it has no cash value. You do not get any ownership of our software, artwork or other intellectual property. You may not sell or transfer a character outside the game.

Prices and payment

Prices are shown before you pay, in New Zealand dollars, and are the full amount you will be charged. A character's price depends on its rarity tier. Taking a child home costs a share of that child's listed price. Payments are processed by Stripe; we never see or store your card number.

A name is held for you for 30 minutes while you pay. If your payment goes through but the character cannot be born (for example the name was taken after the hold ran out), we refund you in full automatically.

Refunds

Your character is delivered as soon as payment completes, so we do not offer refunds for a change of mind. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1993. If something has gone wrong, email us and we will put it right.

Your player key

Your characters are linked to a private player key kept in your browser. Keep it safe and do not share it: anyone with the key can manage your characters. If you lose it, email us from the address on your receipt and we will help you recover access.

Fair play

Do not use names that are hateful, obscene, impersonate a real person in a harmful way, or infringe someone else's rights. We may rename or remove such a character and refund what you paid for it. Do not attempt to interfere with the game, its servers or other players.

The game will change

Cipher Evolution is growing. Characters are always drawn from the same nine cipher values, but how they look, the rules of matching and merging, and the features available may change as the game develops. We will try to keep your characters recognisably yours. If we ever close the game we will give at least 60 days' notice.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to the amount you have paid us in the previous 12 months. This does not apply where the Consumer Guarantees Act gives you rights that cannot be excluded.

Law

These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction.
